和美国警察遭遇的经历 My Encounters with American Policemen

在美国我们生活工作了七年,有过两部车,加在一起行驶的里程超过了400,000公里,相当于绕了地球10圈左右,主要是因为常开车去另一个城市出差,也有自驾游的因素。里程数多了,自然出现违章的机会也变多了。在七年的时间里我有六次遭遇警察的经历。

除了在纽约这样特别繁忙拥挤的大城市里,美国警察很少站在路口执勤,他们基本上不是开着警车在路上巡视,就是把车停在路边,用测速器测过往车的速度,发现有违章的车再追上去执法。

第一次遭遇美国警察是在2012年的冬天,我刚到美国工作不久。在美国上班时间早,我一般早上七点钟到达单位。冬天早上六点多的时候天还没完全亮,因为光线不太好,我开得并不快。开着开着突然发现后面有辆警车闪着灯跟上来,于是便在路边停车。那辆警车停在离我有二三十米的距离,我依稀可以看到是位黑人女警官。我知道我应该在车里等她过来,但是我等了好几分钟,她也没动静,后来才知道她在系统里查我的车的档案信息。那天我赶着去单位开会,看看要晚了,就想不如主动点儿,赶快把这事给结了。于是我下了车向她走去,但还没走两步,她一手指着我,一手握着腰间的手枪,大声喝斥,命令我立即回到车里,真是声色俱厉。我吓了一跳,相信如果我不服从她的命令,她会立刻开枪射杀。我赶紧回车里坐好,又等了几分钟她才过来,看过我的驾照之后,她问我知不知道违了什么章。我说我没超速,不知道做错了什么。她说确实没有超速,但是我开到了非机动车路上了。原来这条路虽然宽但一个方向只有一条车道,右边白线以外是临时停车的地方,那时候天黑,我也没看清白实浅,以为那也是条车道,所以确实违章了。之后她开了罚单,还给我讲了去哪里可以交罚单便放我走了。在我回到车内之后的对话还算是心平气和。


第二次遭遇警察才是因为超速。在本地的高速上一边开电话会议一边开车,路况非常好,一不小心就超速了。拦下我的是位年轻的男警官,开完罚单后可能看我有点郁闷,他说他一般只罚超过限速15英里以上的司机。我在限速60英里每小时的的路上开了79,已经超过他特别宽松的标准了,不要感觉太冤。我当时也没因为他的安慰而感觉更好。直到有一次我因为在70英里限速的路上,因开了81迈而被处罚之后才体会到那个年轻警察的好。



在美国接到罚单之后,是有一个申诉期的,在这个期间里面如果不服受到的处罚,可以去指定的法庭申诉。我没有去法庭申诉过,主要是因为听了一个同事的亲身经历。同事有一次聊天时说能不申诉还是别申诉,浪费时间不说,还不知道结果是变好还是变坏。他说他有一天开车迷路了,刚好看到前面有一个警察停在路边,于是他开车过去问路,警察告诉他,他开过来时超速了,因为那是一个学校路段,限速很低。他看到警察后光想着问路了,没注意到学校的标识,觉得特别冤,不服,于是去法院申诉。去法院申诉那天,他说人特别多,法官说下面的人有谁是在学校校区道路上违章的举手,然后他就举手了。法官核对完信息后说你们这些人一起办理,所有人的罚款加倍。因为你们在校区超速了,还不知悔改居然还过来申诉,所以要重罚。听了他的教训,再加上每次拿罚单都是罪有应得,因此没存侥幸心理,没去申诉过。



唯一一次觉得有点儿冤的是因为开车时拿手机而被处罚。那次是在参加完一个团队庆祝活动之后,因为聚餐的地方我不熟悉,于是用手机做导航,由于没有带支架,我就一手把方向盘,一手拿着手机。只是偶尔看上一眼手机。但是还是让一位在路上开车巡视的警察注意到了,可能因为那是晩上,手机打开后有亮光,手拿着比较显眼。路边停车后他讲在当地这样做是违法的,因此又被罚了一百多美金。

不过也有幸运的时候,有一次超速被叫停在路边之后,那个警察过来跟我聊了好一会儿,问是从哪来,来干什么的,在得知我是从外地开车三百多英里来这里建工厂之后,他就提醒我开车注意速度,别太累了,没给我开罚单就走了。

我唯一一次主动报案求助警察是因为有人追尾我的车后,肇事逃逸了。因为当时事情发生得很快,等我反应过来时,那个司机已经逃得没影了。我也没有记下他的车牌号,只记得车型和颜色。好在当场立即有另一辆车的司机愿意为我作证,还告诉了我她所记得的那个肇事司机的车牌号,并留了她的手机号,以备查询和作证。不得不说这个世界上有坏人也有好人,但是好人更多。警察很快赶到了,看了现场,又打了电话给那位愿意作证的司机,之后去警车的电脑里查了一下,说可能那个车牌号没记对,或者逃逸的人用的是假车牌,反正在系统里和我说的车型对不上。他说因为警力有限,别抱太大希望。后来就没下文了,那个跑掉的司机最终也没有抓到。有时想还是中国好,四处都是摄像头,随便查查就可以抓住这种逃逸的司机。

这事发生几天之后,有不少私人侦探主动打电话跟我联系要帮我查这个肇事司机,当然都是要收费的。看看他们的报价,比被追尾后的修车费用还高,最后就放弃了。现在有点儿明白为什么美国电影里有那么多警匪的汽车追逐战,在这里跑掉了还真有可能逃脱法律的制裁。

总体来说,虽然对美国警察追踪坏人的能力有点儿失望,我觉得我所遇到的警察还都算是公正的。

We lived and worked for seven years in the United States. We had two cars. The total mileage for these two cars was more than 400,000 kilometers, which was equivalent to circle the earth for 10 times. It was mainly because we often drove to another city for business. A lot of road trips for vacation also contributed to the high mileage. Normally there are more opportunities to violate the driving laws when the mileage gets higher. I had six encounters with American policemen in those seven years.            

Except in busy and crowded places such as New York downtown, American policemen rarely stand at the intersections. They basically either drive a police car to patrol on the road, or park the car on the side of the road, use a speedometer to measure the speed of passing cars, and then run after the speeding cars to enforce the law.            

The first time I encountered an American policeman was in the winter of 2012. I just came to work in the United States not long ago by that time. I usually arrived at my office around seven in the morning. In winter, it's still dark when it's around 6:45 in the morning. I did not drive fast. While I was driving, I suddenly noticed a police car running after my car with flashing lights. So I stopped at the side of the road. The police car was parked twenty to thirty meters behind my car. I could see it was an Africa American female police officer. I knew that I should wait for her in my car. However, I waited for several minutes and she still didn't come. I learned later that she was checking my car's information in the system. I wanted to go to office to attend a meeting in that morning. I was about late. I thought it would be better to take initiative and close this matter as soon as possible. Therefore, I got out of my car and walked to her. I was stopped by her after I just walked two steps. She pointed her finger at me with one hand and put the other hand on her pistol at her waist. She shouted and ordered me to go back to my car immediately. The tone was fierce. I was a bit shocked and believed that if I disobeyed her order, she would shoot and kill me immediately. I hurried back to the car and waited a few more minutes. Then she finally came to my car. After looking at my driver's license, she asked me if I knew why I was pulled over. I said I didn't drive very fast and I don't know what I did wrong. She said indeed the speed was fine, however I drove on the road which is not for motorized vehicles. Although the road was wide, it had only one lane. The roadside was for temporary parking. I thought it was just a normal lane, so indeed I violated the rule. Then she gave me a ticket, told me where I could pay it and then let me go. The conversation after I got back to the car was peaceful.          

The second time I met a policeman was because of speeding. I was driving while talking in a conference call on the local highway. The road condition was very good, and I did not realize the speed exceeded the limit. I was stopped by a young male police officer. He noticed that I  was a bit upset after the ticket was issued. He said that he usually only punished drivers whose car exceed the speed limit for more than 15 miles. The highway’s speed limit was 60 mile per hour and my car’s speed was 79, which had exceeded his extremely loose standard. I guessed that he did not want me to feel too bad since I was so deserved for the punishment. I didn't feel any better because of his comfort. I only realized how good the young policeman was until I was given a ticket for driving at 81 miles on a 70 mile speed limit highway.           

After receiving the ticket in the United States, there is a period for appeal. During this period, if you refuse to accept the punishment, you can go to a designated court to appeal. I didn't go to any court to appeal, mainly because of one of my colleague's personal experience. He once told me that you never know if the result would be better or worse after the appeal, not to mention the time and effort spent on that. He said he lost his way one day and saw a policeman standing at the side of the road in front of him. He drove his car to the policeman to ask for directions. The policeman told him that he was speeding while he drove here. It was a school district and the speed limit was very low. When my colleague saw the police, he just wanted to ask for directions. He didn't notice the sign of school district. He felt it was not fair and didn't accept it. He went to the court to appeal. On the day when he went to the court to appeal, there were many people. To save time, the judge asked all people who got a speeding ticket on school district roads to raise hands so that he can handle the cases together. My colleague raised his hand. After checking the information, the judge said. “the fine for all of you will be doubled. The reason is you were speeding in the school area. And you do not believe you deserve the ticket and even come here to appeal. You should be punished more severely to remember the lesson". I never went to appeal after listening to his experience. Another reason was I believe I deserved for getting those tickets.

The only time I was not sure if I deserve was that I got a ticket for holding my cell phone while driving my car. It was after a team celebration; I used my mobile phone for GPS navigation because I was not familiar with the place where we had dinner. Since there was no bracket to hold my phone, I held the steering wheel with one hand and held my mobile phone with the other hand. I just took a quick look at my mobile phone occasionally. It was noticed by a policeman who was driving around on the road. Maybe it was because the phone screen was bright in the night. After parking at side of the road, he said it was illegal to do so in his state. I was fined more than $100 for that mistake which I did not know it was an issue before. 

There was also time when I got lucky. One day I was pulled over for speeding. The policeman chatted with me for some time, including asking where I came from and what I came for. After learning that I drove more than 300 miles from another city to build a factory here, he reminded me to pay attention to the speed and don't get too tired. He let me go at the end without giving me a ticket.            

The only time I took initiative to call police and report a case was because someone run away after hitting my car. Because it happened so fast, I could not remember his license plate number. I just remembered the car's model and color. Fortunately, there was another driver who was willing to testify for me. She also told me the runaway car’s license plate number she remembered and left her cell phone number for potential inquiry and testimony. Clearly there are bad people and good people in the world and the good people are much more than the bad people. The police arrived quickly, searched at the scene, called the driver who was willing to testify, and then went to his computer to check it. At the end, he said he could not identify the car based on the given information in his system, maybe because the license plate number was not remembered correctly, or the escaped driver used a fake license plate. He told me not to put too much hope on this because of the limited police manpower. Then there was no follow-up. The driver who run away did not get caught at the end. Sometimes I think it's better in China for this kind of situation. There are cameras everywhere. We can catch this kind of runaway driver just by checking the street cameras.          

A few days after this happened, a lot of private detectives sent me letters to offer help to find out that bad driver. Of course, it was not free. The price they quoted was higher than the cost of repairing the car. Finally, I gave up. Now I understand why there are so many cars’ chasing in American movies. It is indeed possible to escape from the law’s punishment in the US if you run away successfully. 

Overall, although I am a little disappointed for the ability of American police to track down bad people, I think all the policemen I met in the US were fair.

    遇到真没脾气。看来美国的警察还是工作勤奋的。这的司机已经把车直接停在主路上了。也没人管。

    在超速问题上,还是年轻人理解度高呀!
